DATES OF PROMOTION: The "Dal Cuore” Promotion ("Promotion")
begins on February 11, 2009 and ends on February 12, 2009, or while
quote card supplies last (“Promotion Period”). Promotion
valid at participating Carrabba’s Italian Grill locations in
the 50 United States and the District of Columbia. VOID WHERE PROHIBITED.
ELIGIBILITY: Entrants must be legal residents of the 50 United
States and the District of Columbia, who are 18 years of age or older
at time of entry. Employees and their immediate family
members (parents, children, siblings or spouse, regardless of where
they live, or persons living in same household, whether related or
not) of Carrabba’s ("Sponsor"), its parent companies,
affiliates, contractors, subsidiaries, distributors, sales representatives,
retailers, advertising and promotion agencies, and any others engaged
in the development, production, execution or distribution of this
Promotion, including, but not limited to, the entities supplying
the prizes herein (collectively the "Promotion Entities"),
are not eligible to participate.
HOW TO PARTICIPATE: There are two (2) ways to obtain a quote card:
A. WITH A PURCHASE: Visit any participating Carrabba’s
Italian Grill location, and receive one (1) quote card per guest
for every dining experience during the Promotion Period, while supplies
last.
B. WITHOUT A PURCHASE: To receive a quote card without making
a purchase at a participating Carrabba’s location (while supplies
last), send a self-addressed, stamped business-size envelope to:

693 East Avenue, Ste 302, Rochester, NY 14607. VT residents
may omit return postage. Mail-in requests must be postmarked by February
12, 2009 and received by February 20, 2009. Limit one request
per envelope, mailed separately. One quote card will be sent for
each request received. Limit four (4) requests per person. No copies
or reproductions of free requests will be honored.
LIMIT 4 quote cards per person for the entire Promotion.

see if the quote on your quote card exactly matches any of the quotes
posted on the website. If the quote on the website matches
exactly the quote on the quote card you received, you are a winner,
subject to verification. Then follow the redemption information
posted on the website to redeem your prize or See PRIZE CLAIMS section
of these Official Rules for further details on redemption. Any quote
card that is mutilated, altered, copied, forged, water damaged, manipulated
or tampered with in any way, or that contains any printing, mechanical
or typographical errors, will be considered void and will not be
eligible for prize redemption.
PRIZES/ODDS:
Grand Prize: One (1) Grand Prize of an 8 day/ 7 night MSC Italian/Mediterranean
Cruise for two (2) will be awarded. Grand Prize winner and one (1)
travel companion will receive: a) an 8 day/ 7 night trip with choice
of one of the available ships below, b) round trip coach airfare
to and from a major airport nearest winner’s home to the port
of departure, c) accommodations in a balcony stateroom, d) meals
in standard dining rooms, e) $500 American Express Travel Voucher,
and f) one (1) certificate for Carrabba’s dinner for four ($90
value). The approximate retail value (ARV) of the Grand Prize is: $7,090.00. Odds
of winning a Grand Prize are 1:200,000.
Ships available for the Grand Prize:
MSC Poesia: Eastern Mediterranean roundtrip from Venice
MSC Splendida: Western Mediterranean roundtrip from Barcelona (includes
Italy)
MSC Fantasia: Western Mediterranean roundtrip from Genoa (includes
Italy)
Expenses of personal nature (including without limitation, gratuities,
phone calls, shore excursions, gift shop purchases, some beverages,
meals in alternate dining venues, etc.) are the financial responsibility
of the Grand Prize winner. Winner must complete travel by March 31,
2010. Any taxes imposed on the income of the Grand Prize winner as
a result of winning the Grand Prize and all other expenses not specifically
mentioned herein as part of the Grand Prize are solely the responsibility
of the Grand Prize winner. All travel subject to space availability
at time of request, blackout dates including holidays and other restrictions
may apply. Winner must give 60 days notice prior to intended date
of departure. Grand Prize winner and travel companion must travel
on same itinerary and must have valid required travel documents (i.e.,
valid photo ID, passport, birth certificate) before departure. Grand
Prize winner and travel companion are solely responsible for determining
and obtaining, each at his/her own cost, required travel documents.
All minors (based on age of majority in resident’s province)
must be accompanied by minor's parent or legal guardian. Travel companions
(or their legal parent/guardian of a minor) must sign and return
a liability/publicity release.
First Prize: Five (5) First Prizes of a Carrabba’s Private
Dining Experience (Dinner for 10, excluding alcohol) will be awarded.
The ARV of each First Prize: $250.
Odds of winning a First Prize are 1:40,000.
Second Prize: Twenty (20) Second Prizes of a Carrabba’s
dinner for four (4) will be awarded. The ARV of each Second Prize:
$90.
Odds of winning a Second Prize are 1:10,000.
Odds of winning are based on the distribution of all official quote
cards. There will be approximately 200,000 quote cards available
to be distributed in the Promotion. The total maximum ARV of all
prizes is $10,140. No prize substitution, except at Sponsor’s
sole discretion or otherwise provided herein. Prizes are not
transferable prior to award and Prizes have no cash value. Sponsor
reserves the right to substitute any portion of this prize with a
prize of comparable or greater value. Any taxes on the Prizes
are the sole responsibility of the winner.
If for any reason, including, without limitation, a printing, production
or other error occurs and more prizes are claimed in a category than
the number set forth in these Official Rules, all persons making
purportedly valid claims for that prize will be entered in a random
drawing from which winners for only the advertised number of prizes
in that category will be selected. No more than the number of prizes
set forth in these Official Rules will be awarded. Any unclaimed
prizes will not be awarded.
PRIZE CLAIMS: All prize claims are subject to verification by an
independent judging organization whose decisions are final and binding
in all respects. All potential Prize winner(s) are subject
to verification of eligibility and compliance with the Official Rules
before any prize will be awarded. To claim your prize,
begin by making a photocopy of the winning quote card for your files. Send
original winning quote card, by traceable delivery service, certified
or registered mail return receipt requested, or first class mail
(your preference). No copies or mechanical reproductions
accepted. For all prize levels, include a 3x5 card, legibly printed
or typed with your full name, complete physical address with zip
code (No PO Boxes), daytime phone number, age, and e-mail address
(if available), to: Carrabba’s “Dal Cuore” Prize
Claim, 693 East Avenue, Ste 302, Rochester, NY 14607. Prize
claims must be postmarked by March 9, 2009 and received by March
17, 2009. All prize claims will be verified by March 20, 2009. Please
allow 6-8 weeks for delivery of your prize after verification date. All
Official quote cards submitted for verification become the sole property
of Sponsors and will not be returned.
PRIZE WINNERS: Except where prohibited, Grand Prize winner
will be required to sign and return an Affidavit of Eligibility and
Liability/Publicity release, W-9 Form, and Travel Companion Waiver
(“Paperwork) within fourteen (14) days of notification in order
to claim the prize. If a potential Prize winner fails to sign
and return the Release within the required time period, the potential
Prize winner forfeits his/her right to the Prize and an alternate
winner will be selected. Each potential Prize winner consents
to use of his/her name, likeness, biographical information, and voice
in advertising worldwide without additional compensation (TN residents
will not be required to sign a publicity release as a condition of
winning a prize). The Prize is taxable as income and the Prize winner
is solely responsible for any taxes relating to the Prize, including,
but not limited to all applicable federal, state and local taxes.
GENERAL RULES OF PARTICIPATION: By participating in this Promotion,
entrants, and winners release each and all of the Promotion Entities,
from any and all liability, damages or causes of action (however
named or described) with respect to or arising out of participation
in the Promotion, and/or the receipt or use/misuse of the prizes
awarded, including, without limitation, liability for personal injury,
death or property damage. By participating in this Promotion,
entrants agree to be bound by these Official Rules and the decisions
of the judges, which are final in all respects and not subject to
appeal. Sponsor reserves the right permanently to disqualify
from this Promotion any person it believes has violated these Official
Rules. All Promotion materials and quote cards are subject
to verification and are void if (a) not obtained in accordance with
these Official Rules and through legitimate channels, (b) any part
is counterfeited, altered, defective, damaged, illegible, reproduced,
tampered with, mutilated or irregular in any way, (c) are obtained
where prohibited, or (d) they contain printing, typographical, mechanical,
seeding or other errors. Sponsor’s liability for defective
Promotion materials and quote cards is limited to replacement while
supplies last. Entrants assume all risk of loss, damage, destruction,
delay or misdirection of Promotion materials, game pieces and mail
submitted to Sponsor. All federal, state and local laws apply. In
the event any portion of this Promotion is compromised by activities
beyond the control of the Sponsor which, in the sole opinion of the
Sponsor, corrupt or impair the administration, security, fairness
or proper play of the Promotion, Sponsor reserves the right at its
sole discretion to modify, suspend or terminate the Promotion.
Promotion Entities are not responsible for lost, late, misdirected,
undeliverable or incomplete entries. Sponsor may prohibit an
entrant from participating in the Promotion or winning a prize if,
in its sole discretion, it determines that said entrant is attempting
to undermine the legitimate operation of the Promotion by cheating,
hacking, deception, or other unfair playing practices (including
the use of automated quick entry programs) or intending to annoy,
abuse, threaten or harass any other entrants, Sponsor, or Promotion
Entities. If for any reason this Promotion is not able to be conducted
as planned, including, but not limited to, by reason of tampering,
unauthorized intervention, fraud or any other causes beyond the reasonable
control of Sponsor which corrupt or affect the administration, security,
fairness, integrity or proper conduct of the Promotion, then Sponsor
reserves the right at its sole discretion to cancel, terminate, modify
or suspend the Promotion. CAUTION: ANY ATTEMPT BY AN ENTRANT
TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION
OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND
SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK
REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH
ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
No Liability: By participating, entrants agree to release,
discharge, indemnify and hold harmless the Promotion Entities and
each of their respective officers, directors, employees, representatives
and agents from and against any claims made by winners, entrants,
or any other third parties, related in any way to the operation of
this Sweepstakes as well as any other claims, damages or liability
due to any injuries, damages or losses to any person (including death)
or property of any kind resulting in whole or in part, directly or
indirectly, from acceptance, possession, misuse or use of any prize
or participation in any Promotion-related activity or participation
in this Promotion.
